Confirmation of Student Status for "Work Experience Student" under Minimum Wage Ordinance (Cap. 608)

The Minimum Wage Ordinance (Cap. 608) has come into force since 1 May 2011 but statutory minimum wage does not apply to the following specified student employees under the Ordinance:

  • student interns;
  • and work experience students during a period of exempt student employment.

If you are under the age of 26 years at the beginning of employment and if you and your employer agree to treat a certain period of your employment as a period of exempt student employment, UG Student Development and Career Services Team would help confirm your student status for "work experience student" under Minimum Wage Ordinance (Cap. 608).

To confirm your student status for “work experience student”, please send the following documents at least 4 weeks before the employment commences to bmcareer@ust.hk

Completed Confirmation of student status for “work experience student” under the Minimum Wage Ordinance (Cap. 608) Form

with the following details

  • Academic Year (e.g. 2024-25 Sep 2024 to Aug 2025)
  • Full Name (same as HKID)
  • HKID No.
  • Programme Enrolled

Copy of the employment contract / appointment email (in pdf or outlook message format)

with the following details

  • Your name
  • Job Position
  • Employment Period (with Start Date and End Date)
  • Working hours
  • Salary

Copy of your Student ID

Please be reminded that under the Ordinance, "work experience student" and his/her employer may agree to treat a continuous period of up to 59 days as exempt student employment, i.e. 59 days is the maximum day of exempt student employment and the statutory minimum wage ordinance applies from your 60th day of employment.

Statutory Declaration for a Period of Exempt Student Employment Contract

After your student status has been confirmed by the School, you have to make the statutory declaration before the commencement of the exempt student employment and provide a copy to the employer. Specimen Content of statutory declaration could be downloaded here.
